These Terms of Service ("Terms") govern your access to and use of the Xoul website at xoulapp.com and the Xoul mobile application (collectively, the "Service"), operated by Xoul ("Company," "we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.
You must be at least 18 years old to create a Xoul account. The Service is designed for use by parents and legal guardians to monitor the digital wellbeing of children in their care. By creating an account, you represent that you are the parent or legal guardian of any child whose account you connect to the Service.
You are solely responsible for ensuring you have the legal authority to connect a child's messaging accounts to Xoul. Connecting accounts without proper parental or guardianship authority is a violation of these Terms.
You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
Xoul provides AI-analyzed behavioral wellbeing reports about children's digital activity. The Service analyzes behavioral metadata only — no message content is accessed or stored. Reports are delivered to the parent account holder and are encrypted end-to-end.
Xoul is not a crisis intervention service. If you believe a child is in immediate danger, contact emergency services. Xoul's reports are informational and should not replace professional mental health support where warranted.

Xoul offers free and paid subscription tiers. Paid subscriptions are billed in advance on a monthly or annual basis. Subscriptions automatically renew unless cancelled before the renewal date. Refunds are available within 14 days of initial purchase or annual renewal if the Service has not been substantially used during that period.
The Service is provided "as is" and "as available." We do not warrant that the Service will be uninterrupted, error-free, or that reports will detect every instance of risk or distress. The Service is a monitoring aid, not a guarantee of child safety.
To the extent permitted by applicable law, Xoul shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved in the courts of Travis County, Texas.
We may update these Terms from time to time. We will notify registered users by email at least 30 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
